The petitioner, on April 8, 1939, entered a plea of not guilty to an indictment charg ing him with murder in the first degree. He was at all times represented by competent counsel. Thereafter, on April 22, 1939, he requested permission to change his plea. Permission was granted, and he pleaded guilty to murder in the second degree. This plea was accepted on May 8, by the single judge regularly assigned to hold the criminal session.
