This suit was brought by appellee for the recovery of damages for personal injuries received by him while in the employ of appellant. He alleged that the appellant owned and operated an oil mill in Belton, and had in its employ a large number of men, whose duty it was to perform all the labor and work necessary in the operation of said mill; that on the 13th of October, 1908, he was employed by appellant as a laborer in said mill, continuing his services until November 13, 1908, the date of his injury; that during the time of his employment he was engaged in working in…
