Plaintiff, Irene Murphy, was injured as the result of a fall on the porch steps of her residence, owned and maintained by her landlord, William Messerschmidt, defendant. Following a jury trial, a verdict was returned in plaintiff’s favor. On appeal, the appellate court ruled that the circuit court of Madison County had committed several evidentiary errors and that, even absent the evidentiary errors, the plaintiff had failed to prove either negligence or that the defendant’s conduct was the proximate cause of plaintiff’s injury.
