GASCH, District Judge.
Aggrieved by certain informal action taken by the Food and Drug Administration (“FDA” or “Agency”), plaintiff Abbott Laboratories (“Abbott”) seeks de novo review of the Agency’s factual findings and declaratory and injunctive relief reversing the Agency’s resolution of pertinent legal issues. Abbott seeks this judicial review under the Administrative Procedure Act (“APA”). 5 U.S.C. §§ 701-706.
