—Judgment unanimously modified on the law and as modified affirmed and matter remitted to Onondaga County Court for further proceedings in accordance with the following Memorandum: Defendant agreed to plead guilty to murder in the second degree and burglary in the first degree in return for an indeterminate sentence of incarceration of no greater than 20 years to life on the murder conviction with a concurrent sentence on the burglary conviction.
