DAVIDSON, Presiding Judge.

Appellant was convicted of murder, his punishment being assessed at twenty-five years confinement in the penitentiary.

The State relied upon the fact that appellant and Virgil Vasser killed Green Vasser, the father of Virgil. It is deemed unnecessary to go into a statement of the facts. Virgil Vasser turned State’s evidence and testified. There are two or three bills of exception reserved' to the action of the court permitting certain witnesses to testify to statements made by Virgil Vasser, who was also called Boozer Vasser.
