ORDER

PORTEOUS, District Judge.

Before the Court, is American Casualty Insurance Company’s (“American Casualty”) motion for summary judgment under Fed. R. Civ.P. 56(c). The Motion was taken under submission after oral arguments on the 9th of September 1995. After considering the record, briefs filed by counsel, the applicable law, and the legislative history, American Casualty’s motion for summary judgment is, hereby, DENIED.
