WOODS, Circuit Judge.
On June 27, 1917, Donald P. Davis, sheriff of Mineral county, W. Va., in the execution of a warrant he held for the arrest of the defendant, Peter Weissengoff, stepped upon the running board of defendant’s automobile as he was driving through the town of Piedmont, W. Va. The car was not stopped, but continued in somewhat rapid motion until it struck an abutment of the Potomac bridge between Piedmont, W. Va., and Westernport, Md., and killed Davis.
