This is an action to recover assessments on a policy of fire insurance on property located in Hew York State, issued by the Atlas Mutual Insurance Company, a mutual insurance company created and existing under the laws of Massachusetts, and not authorized, pursuant to the provisions of the Insurance Law (§§ 9 and 25), to transact the business of insurance in this State. The defense is tiiat *438the contract sued upon was made in the State of New York and is, therefore, void.
