MEMORANDUM AND ORDER

KATZ, Senior District Judge.

On April 27, 1998, defendant Brian Hancock pled guilty before this court to one count of possession of a firearm by a convicted felon in violation of 18 U.S.C. § 922(g)(1). Now before the court is Hancock’s motion for a downward departure. Upon consideration of the submissions of the parties, and after a sentencing hearing, the court, ruling from the bench, granted the motion on the following independent grounds: the case falls outside of the heartland, the defendant’s conduct was aberrant, and the totality of the circumstances warrants a…
