The defendant, at all times herein mentioned, was the owner and in possession of a farm and farm buildings located on route 5, the main road leading from Oneida to Syracuse. The defendant did not reside on the farm. The farm house was occupied by Isaac A. Barriger and his wife. Mr. Barriger was employed on the farm by the defendant. The farm and the farm buildings are located on the southerly side of the highway. The farm buildings stand on an elevation above the highway and about 150 feet distant therefrom.
