This matter is before the Court on the Petition for Habeas Corpus filed by Steven Stuart Marks, on the Commonwealth’s Motion to Dismiss, and on Marks’response to the Motion.

At a trial on October 2, 2009, a jury found Marks guilty of three counts of aggravated sexual battery in violation of Va. Code Ann. § 18.2-67.3, and, at a hearing on February 25, 2010 (memorialized by an order entered on February 26, 2010), the Court, consistent with the jury’s recommendation, sentenced Marks to six years on each of the violations, to run consecutively, and suspended three years of…
