OPINION
FINDINGS OF FACT AND CONCLUSIONS OF LAW
EDWARD WEINFELD, District Judge.
This is an action brought pursuant to 42 U.S.C., section 1983 1 and under the Eighth Amendment to the United States Constitution. 2 The plaintiff, who was sentenced in 1965 to a term of from twenty years to life imprisonment, following his conviction for murder in the first degree, is currently incarcerated at Green Haven Penitentiary, a state facility in Stormville, New York.
