KORMAN, Chief Judge.

Tinh Phan seeks habeas corpus relief from his conviction for one count of second-degree murder, one count of criminal possession of a weapon in the second degree, and one count of criminal possession of a weapon in the third degree. After a jury trial, petitioner was sentenced to concurrent terms of twenty years to life for the murder conviction, three to nine years on the second-degree weapon charge, and two to six years on the third-degree weapon charge.
