This action was brought to recover treble damages for malicious trespass upon lot 3, section 19, township 148 north, range 32 west, Beltrami county, this state. There was a trial in the district court and a verdict in favor of plaintiff for $300 as treble damages. Defendants moved for judgment or for a new trial and appealed from ■an order denying their motion.
