I write to elaborate on the facts and the law of this case.
Under a three-way contract, William E. Rice, the plaintiff/appellant, was employed by Cities Sewer as vice president and general manager, subject to Gladys M. Pugh’s direction. On June 17, 1983, Cities Sewer terminated Rice. On June 22, 1983, Cities Sewer filed a replevin action against Rice and his wife, to recover two automobiles owned by the company which were in the Rices’ possession, as well as some documents and keys.
