This case, which comes to the writer on reassignment, is a suit for the partition of certain real estate situated in St. Charles County and owned by one Rebecca Studer at the time of her death on October 31, 1927. By the terms of her will, which was duly admitted to probate in the Probate Court of St. Charles County, the deceased devised the real estate in question in equal shares to her four children, Laclede Studer, Nettie Penny, Ethel Aubuchon, and Maud Young, subject, however, to the specific provision contained in the will that if she should have paid out any money on account of having…
