— In an action to recover damages for breach of contract, the defendants appeal from an order of the Supreme Court, Nassau County (Levitt, J.), dated September 16, 1985, which granted the plaintiffs’ motion for a *562protective order and denied their cross motion for a protective order and for a "declaratory judgment” disqualifying the plaintiffs’ attorney.

Ordered that the order is modified, by adding a provision that the motion is denied, without prejudice to a further application by the defendants for leave to depose the plaintiffs’ counsel, upon proper notice, if it is warranted. As so…
