Plaintiff in error, R. A. Goldman, was jointly indicted along with S. Goldman, in the Hustings Court of the city of Roanoke, *878for feloniously 'buying and receiving certain railroad brass, known as switch-locks, the property of the Norfolk and Western Railway Company, with intent to defraud. There was a demurrer and motion to quash the indictment, both of w'hich were overruled, and thereupon the prisoner, R. A. Goldman, pleaded not guilty. At the trial, the jury found the. prisoner guilty, as charged in the indictment, and fixed his punishment at sixty days in the city jail. .The court…
