On June 16, 2009, the court entered an order denying Defendants’ Motion to Dismiss the Complaint for Lack of Subject Matter Jurisdiction. The court concluded that it has subject matter jurisdiction over this action under 28 U.S.C. § 1332 because the parties are diverse in citizenship and the amount in controversy exceeds $75,000.00.
