OPINION OF THE COURT

Respondent was admitted to the practice of law by this Court on September 18, 1979, and formerly maintained an office in Rochester. The Grievance Committee filed a petition containing multiple charges of misconduct. Respondent’s answer *203denied the material allegations of the petition and a Referee was appointed to conduct a trial on the issues of fact raised by the pleadings. On July 8, 1996, respondent was convicted, upon a plea of guilty, of driving while intoxicated, a felony, in violation of Vehicle and Traffic Law § 1192 (3) and § 1193 (1) (c). On July 24, 1996, an…
