This is the second appeal in this case, the first having been been decided in Division No. 2 of the Supreme Court of Missouri and reported at 456 S.W.2d 328 resulted in a reversal and remand because of the absence of a necessary party, Wanda Thurman, who has been joined in this present proceeding in a party-plaintiff-appellant.
