This is an appeal from a part of an order made by the Honorable Thomas H. Pugh, as judge of the district court of Burleigh County, on December 27, 1928, whereby the application of the plaintiffs for a temporary injunction was denied and a restraining order previously obtained was vacated. The action was brought for the purpose of securing an adjudication to the effect that the nomination and election of the defendant R. G.
