WARRINGTON, Circuit Judge.
The appeals in these cases are from decrees entered in two infringement suits which were based upon the same patent. The decree in' the first suit was made upon final hearing, with pleadings and proofs, sustaining the validity of the patent, and awarding a perpetual injunction and an accounting;1 and in the second suit the decree was purely interlocutory, granting a preliminary injunction upon pleadings and affidavits.
