Appellant (plaintiff) sued respondent (defendant) alleging that, pursuant to an oral agreement between plaintiff and defendant, defendant owed plaintiff $5,000 for certain services performed by plaintiff for defendant in connection with the leasing of real estate owned by defendant and another to a third person. The circuit court sustained defendant’s motion to dismiss plaintiff’s second amended petition for failure to state a claim upon which relief could be granted. Thereafter plaintiff did not seek leave to amend his pleading in the trial court pursuant to Rule 67.05 but…
