Motion for an order directing the plaintiff to (a) assign and deliver to a nominee of the defendant William Rogers the mortgage now held by it, and (b) to direct the plaintiff to discontinue this action only as against the defendants, William Rogers and his wife. Cross motion to strike out the answer and for summary judgment.
