PETITION FOR WRIT OF MANDAMUS

This petition for a writ of mandamus arises out of a contract between Kenco Signs Awning Division, Inc. (a Florida corporation engaged in the business of manufacturing signs), and CDC of Dothan, L.L.C. d/b/a TGI Fridays. Pursuant to the contract, Kenco was to manufacture, deliver, and install signage on the TGI Fridays restaurant in Dothan. The agreed-upon purchase price of the signage was $32,952; the payment terms of the contract called for CDC to pay a deposit of 50% of the purchase price; to pay 30% of the purchase price before installation of the signage; and…
