This matter is before the Court on the motion of New England Telephone and Telegraph Company (“NET” or “defendant”) for summary judgment. This action was brought by M. Richard Trombley (“plaintiff’) claiming that NET has wrongfully denied him benefits to which he is entitled under the terms of the NYNEX Management Pension Plan (“NYNEX Plan”). In his Amended Complaint, plaintiff has asserted two claims under the Employees’ Retirement Income Act of 1974, 29 U.S.C. §§ 1001 et seq. (“ERISA”) and three claims under state common law.
