Harry Lee Butler was convicted of first-degree murder and sentenced to death for the March 1997 murder of his former girl-*644Mend, Leslie Fleming. This Court affirmed Butler’s conviction and death sentence on direct appeal. See Butler v. State, 842 So.2d 817 (Fla.2003). On July 13, 2004, Butler filed a motion to vacate his conviction and death sentence pursuant to Florida Rule of Criminal Procedure 3.851 in the Sixth Judicial Circuit in and for Pinellas County.
