Appeal by the defendant from a judgment of the Supreme Court, Kings County (Murray, J.), rendered April 18, 1983, convicting him of robbery in the second degree, upon a jury verdict, and imposing sentence.

Judgment reversed, on the law, and new trial ordered. The facts have been considered and determined to be established.

The defendant and three others robbed the complainant of her jewelry and purse in a subway car. During the robbery, the complainant’s arm was scratched and one of the perpetrators choked her. She testified that she bled from the mouth and sought medical treatment for her…
