This matter was set for trial on September 22, 2003. On the morning of trial, Plaintiffs counsel, David Carmichael, moved to exclude Defendant’s exhibits as not being timely. The court allowed the parties to submit written arguments supporting their positions. The trial was rescheduled to November 4, 2003.

Defendant hand delivered its exhibits to Plaintiff on Monday, September 15, 2003. A copy of those exhibits was given to a cornier on Friday, September 12,2003, for delivery to the court. The court received Defendant’s exhibits on Tuesday, September 16, 2003.
