On October 24, 1910, John Cook subscribed to an affidavit before a notary public making complaint that defendant and Joe Bitzkus, bis brother, were guilty of disturbing the peace, challenging to fight, etc. This affidavit was filed with a justice of the peace as a complaint and a warrant issued thereon by the justice. Defendant and his brother were arrested, tried, found guilty by a jury before the justice and fined fifteen dollars. An appeal from the judgment was taken to the County Court.
