Appeal from a judgment of the County Court of Chemung County, rendered July 22, 1976, upon a verdict convicting defendant of the crime of rape in the first degree and sentencing him as a second felony offender, to an indeterminate term of imprisonment with a maximum of 16 years and a minimum .of 8 years.
