Appellant, LaMance, was charged, by an information filed in the Circuit Court of Linn County, Missouri, with the murder of his wife, Ella LaMance. A change of venue was granted and the cause was transferred to Chariton County, Missouri. The regular judge was disqualified and the Honorable James S. Rooney presided at the trial. A jury found LaMance guilty of murder in the second degree and fixed his punishment at eighteen years' imprisonment in the penitentiary. From the sentence imposed LaMance appealed.
