OPINION AND ORDER

TURK, Chief Judge.

Plaintiffs are locomotive engineers employed by the Norfolk and Western Railway Company (N & W), who have formed an unincorporated association known as the Employees Protective Association which is here challenging the *685opinion and award of the Special Board of Adjustment No. 813. The case is now before the court on the motion of the defendant, Norfolk and Western Railway Company, to dismiss the plaintiff’s amended complaint for lack of subject matter jurisdiction.
