This action was originally brought by Henry J. Ralph, by writ of summons dated May 8, 1908, and served upon the defendant on the same date. The suit was brought without the intervention of the guardian of the plaintiff; and when it was subsequently made to appear, upon proceedings taken on behalf of the defendant, that the plaintiff had been placed under guardianship, as a person who, from excessive drinking and dissipation, being incompetent to manage his estate, was liable to become a charge upon the town, by decree of the Court of Probate of the town of Cranston, dated May 29, 1882, and…
