STEPHEN H. ANDERSON, Circuit Judge.
Kenneth Alan Lowe appeals his resentenc-ing for conspiracy to transport stolen property across state lines in violation of 18 U.S.C. §§ 371, 2314, and aiding and abetting a robbery that obstructed, delayed and affected interstate commerce in violation of 18 U.S.C. §§ 1951-52. He argues that the district judge improperly departed upward in violation of the Sentencing Guidelines, predetermined his sentence in violation of his due process right to a fair sentencing, and should have recused himself from the resentencing. We affirm.
