Folkways Broadcasting Company appeals from orders of the Federal Communications Commission denying a construction permit, 1 refusing to rehear that decision, 2 and declining after inception of this appeal to seek a remand to enable administrative reconsideration. 3 Though, on the record then before the Commission, we do not fault its ruling an the permit application, we find that its action has been eroded by events occurring during pendency of the appeal.
