I am unable to concur with tlie views of my associates in this action, and. feel called upon to state my reasons.
This is a taxpayer’s action brought by the plaintiff, a citizen and resident of the borough of Queens, for the purpose of restraining certain official acts which are alleged to be illegal, and the waste of public funds. An injunction order was made by one of the justices of this court, forbidding the defendant Dalton, as commissioner of water supply, to make any contract in behalf of the city with the defendant corporation, the Citizens’ Water Supply…
