In these two consolidated appeals, Plaintiff Nippon Fire & Marine Insurance Co., Ltd. (“Nippon”), the subrogated insurer of Toshiba America Information Systems, Inc. (“Toshiba”), challenges two final judgments of the United States District Court for the Southern District of New York (Denise Cote, Judge) granting the defendants’ motions for partial summary judgment. The District Court held that Defendant Skyway Freight Systems, Inc.
