This appeal arises from a denial by the trial court of a motion for rehearing or, in the alternative, a motion, under GCR 1963, 528, to set aside a default judgment of $125,000 taken against appellant Unit Crane & Shovel Corporation.
The genesis of the action was on October 3, 1963, on the premises of the Chevrolet assembly plant of General Motors Corporation in Flint. Michael McDonough sustained injuries resulting in his death when a cable or chain of a stiffleg derrick became detached, causing the cable of the derrick to strike him.
