WILSON, District Judge.
The City of Louisville, Kentucky, has appealed from the decision of the District Court awarding damages to Rockwell Manufacturing Co. for breach of a contract to purchase parking meters. The appellant contends that the trial court was in error both in finding that an enforcible agreement existed between the parties and in excluding evidence relevant to this finding. Further, the trial court misconstrued the nature and provisions of the agreement, so it is con tended. Finally, errors are complained of in the award of damages.
