Fred Robert Cofer filed a petition for a writ of habeas corpus in which he contended that he had been convicted illegally of both motor vehicle theft and of receiving stolen property, to wit the same automobile he was convicted of stealing. In such petition he also contended that he was erroneously considered a fourth offender when, in fact, he was only a second offender and that it was error for the trial court to admit evidence of his prior criminal record during the guilt phase of the trial.
