This matter is before the court on defendants MCAP Christiansburg, LLC and Commonwealth Assisted Living, LLC’s (collectively “Commonwealth”) first motion for summary judgment as to liability, ECF No. 57, and second motion for partial summary judgment as to damages, ECF No. 59.
