GREMILLION, Judge.

_JjFrom the denial of his motion for summary judgment on the issue of liability, Plaintiff/Relator, Mr. Lionel Lewis, has applied to this court for supervisory relief. We granted Relator’s application. For the reasons that follow, we reverse and render judgment in favor of Relator.
