delivered the opinion of the Court.

The defendant, Jerry Paul Cooper, was tried before a judge, sitting without a jury, in the Criminal Court of Baltimore on a charge of assault with intent to rape and was found guilty, tie filed a motion for a new trial, which was denied, and he was subsequently sentenced to life imprisonment and was ordered to be sent to the Patuxent Institution for examination as a possible defective delinquent. He appeals from the judgment and sentence.
