Harry Lee was convicted of simple larceny. While the ease was pending in this court on appeal excepting to the overruling of the defendant’s motion for new trial, the defendant made an extraordinary motion for new trial. The defendant’s conviction was affirmed by this court on April 25, 1940. Lee v. State, 62 Ga. App. 556 (8 S. E. 2d, 706). The judge overruled the extraordinary motion for new trial on June 7, 1940, and the defendant excepted.
