DAVIDSON, Presiding Judge.

Appellant was convicted of assault to murder and allotted five years in the penitentiary.

The evidence discloses two theories. The State’s contention was put in evidence by the assaulted party, appellant’s wife. She says she had been to church, and came home about 11 o’clock at night; that when she and her husband retired she accused him of being intimate with another woman, using pretty vigorous language.
