On the 28th of February, 1921, plaintiff individually and as life tenant and executrix of the will of Charles Smith, and the defendant entered into a contract in writing whereby plaintiff agreed to sell and convey to the defendant and defendant agreed to purchase the premises known as No. 107 East Thirty-first street, borough of Manhattan, New York.
