Appeal by Isaac Siegel, intervenor, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 30th day of November, 1914, directing the opening of the ballot boxes in certain election districts in the county of New York and the removal therefrom of certain ballots.

Scott, J.:

Although the defendant' named in the proceeding is the county board of canvassers of the county of New York, the order requires that certain things be done by the board of elections, a totally different body. These things are to produce certain ballot boxes at the office of said board of elections, and to open the same and to permit an examination of the ballots contained in said boxes cast for candidates for the office of member of "the House of Representatives from the twentieth congressional district of the State of New York.
